1. About these terms
These terms explain use of malsh.ca, operated by Dhrumil Vyas as Malsh Photography in Ontario, Canada. Contact malshbydhrumil@gmail.com or +1 289-889-2428 with questions. Using the website does not create a photography booking.
2. Inquiries and booking confirmation
Forms, chatbot replies, WhatsApp messages, and email inquiries start a conversation. They do not reserve a date or guarantee availability. A booking is confirmed only when Malsh expressly confirms it in writing, the session agreement is accepted, and the 20% advance required for new bookings is received. Existing confirmed bookings retain their agreed payment terms. Before committing, you will receive the applicable scope, price, payment arrangements, and other session terms in writing.
3. Prices and session agreements
Quotes depend on location, coverage, deliverables, and other requirements. Confirm taxes, travel, additional charges, quote validity, and payment dates in your written quote. Deposits, cancellations, refunds, rescheduling, weather arrangements, delivery timing, photo count, editing, and image usage are governed by the applicable written session agreement and mandatory law. These website terms do not impose a blanket non-refundable deposit or replace your consumer rights.
4. Website content and sample images
Some website photographs are illustrative sample imagery, identified as such, and are not Malsh client work. Sample imagery demonstrates visual direction and does not promise an identical result. Photography depends on the agreed brief, location, lighting, and other conditions. Website text, logos, and images may be protected by intellectual property rights belonging to Malsh or their respective rights holders. Do not reuse them without appropriate permission or another lawful basis.
5. Your photographs and permissions
Ownership and the licence to use delivered photographs must be addressed in your session agreement. You do not grant Malsh permission to publish your photographs simply by browsing this website or submitting a form. Portfolio, advertising, and social-media permissions should be agreed separately, including permissions needed for other identifiable people and children. Tell us about venue restrictions and any limitations on access or photography before your session.
6. Chat and external links
The current chat offers automated preset information. It cannot confirm a date, finalize a price, or amend a session agreement. Check important details with Dhrumil. Links to WhatsApp, Instagram, and other services are provided for convenience; those services have their own terms and privacy practices.
7. Responsible use
Provide accurate contact details and only personal information you are entitled to share. Do not submit unlawful, abusive, fraudulent, or malicious content; attempt unauthorized access; interfere with the website; or misuse the booking or messaging features. Do not submit sensitive personal or payment information in free-text fields.
8. Privacy
Our Privacy Policy explains the collection and handling of inquiries, website chat, technical information, and third-party processing. Contact us if you need help accessing the website, understanding these terms, or making a privacy request.
9. Availability, disputes, and your rights
We aim to keep the website accurate and available, but interruptions and errors can occur. Contact us to resolve concerns about the website or a session. These terms do not exclude liability or limit rights that cannot lawfully be excluded, and do not require arbitration or waive court access. Ontario law and applicable Canadian federal law govern these terms, subject to mandatory consumer protections and jurisdictional rights that apply to you.
10. Updates
We may revise these website terms and show the updated date on this page. A website update does not change an existing confirmed session agreement without any agreement or notice required by law. Keep a copy of your quote, written agreement, and confirmation for your records.
