Photography Terms & Conditions
Last updated: October 14, 2026
Read these terms with your written quote and session agreement before making an advance payment.
1. Booking and 20% advance
An advance payment of 20% of the agreed total photography fee is required to reserve your booking date. The advance is credited toward your total. Your date is reserved only after Malsh Photography has received the advance, you have accepted the written quote and session agreement, and Malsh has confirmed the booking in writing. Until then, availability is not guaranteed. The remaining 80% is payable by the date specified in your written agreement.
2. Quote and scope
The written quote will identify coverage hours, location, deliverables, total price, applicable taxes, travel or other charges, and payment dates. Additional work or overtime must be agreed with the client. Photo count, delivery timing, editing, and any RAW-file delivery must be confirmed in the session agreement.
3. Copyright and client usage
Unless a different written agreement or applicable law provides otherwise, Dhrumil Vyas, trading as Malsh Photography, retains copyright in photographs he creates. Payment for a session does not itself transfer copyright. The client receives the usage licence specified in the written agreement, including whether use is personal, property marketing, or another commercial purpose. Any transfer of copyright or exclusive commercial licence must be separately agreed in writing.
4. Website, portfolio, and social-media use
Malsh may use selected photographs on its website, portfolio, and social-media channels only where it holds the necessary rights and permissions. Promotional use of identifiable people requires separate, informed permission where required by law. Booking, paying an advance, or accepting these terms does not by itself grant a model release or promotional consent. One client cannot automatically consent for all event guests or other adults. Appropriate parent or guardian permission is needed for children where applicable.
5. Privacy and commercial exclusivity
Tell Malsh before booking if you want a session kept off the website and social media. Malsh can discuss a separately priced contractual non-publication arrangement or commercial exclusivity. Any additional fee must be lawful, quoted, and expressly accepted in writing before booking; no fee is imposed automatically by this page. No charge applies merely to exercise a statutory privacy right, and refusing optional promotional consent does not automatically trigger a fee. A negotiated exclusivity arrangement does not replace anyone’s privacy rights. Contact Malsh to discuss or withdraw promotional consent, subject to applicable law; removal from Malsh-controlled channels cannot guarantee removal of copies already shared by others.
6. Cancellations, rescheduling, and refunds
The advance is not described as automatically non-refundable. Cancellation, rescheduling, weather, photographer unavailability, refunds, and any cancellation charges must be clearly set out in the written session agreement before payment, subject to applicable law. If no session-specific rule has been agreed, contact Malsh to resolve the situation; these terms do not create an undisclosed forfeiture or cancellation fee.
7. Client arrangements
Share the schedule, important moments, venue restrictions, access arrangements, and any privacy concerns before the session. Obtain permissions you are responsible for obtaining. Malsh and the client will agree a realistic plan; attendance, lighting, weather, and venue restrictions can affect what can be photographed.
8. Existing bookings and legal rights
These terms are for new bookings on or after October 14, 2026, unless another effective date is agreed in writing. They do not retroactively amend an existing confirmed booking or replace its agreed advance payment. A specific written session agreement controls agreed session details, subject to mandatory law. These terms do not waive consumer rights, statutory privacy rights, or access to the courts. Ontario law and applicable Canadian federal law apply, subject to mandatory protections that apply to the client.
